١. قبول الشروط
باستخدامك تطبيق «نخلتي» («التطبيق»، «الخدمة») فإنك توافق على هذه الشروط والأحكام وعلى سياسة الخصوصية، ويُعدّ قبولُها شرطًا لاستخدام الخدمة. يُشغّل التطبيق مطوّرٌ فردي مسجّل بموجب وثيقة العمل الحر رقم FL-851804199 («نحن»، «المشغّل»).
٢. وصف الخدمة
«نخلتي» تطبيقٌ خاصٌّ لبناء شجرة العائلة ومشاركتها بين أفرادها: إضافة الأفراد والعلاقات، والملفات، والأخبار، والمناسبات، والاطّلاع على النسب داخل كل عائلة. الخدمة مخصّصة للاستخدام العائلي الخاص، لا للنشر العام.
٣. الأهلية والحساب
- يجب أن تكون بالغًا سنَّ الرشد النظامي وكامل الأهلية لإبرام هذا الاتفاق.
- حسابك هو رقم جوالك، ويُثبَت بالتحقّق عبر رمزٍ لمرة واحدة. أنت مسؤول عن الحفاظ على سرّية وصولك إلى جهازك ورقمك، وعن كل نشاطٍ يتم عبر حسابك.
- تلتزم بتقديم معلوماتٍ صحيحة، وبعدم انتحال شخصية غيرك أو تسجيل الدخول نيابةً عن شخصٍ آخر دون إذنه.
٤. الاشتراك والدفع والتجربة المجانية
- يتطلّب إنشاء شجرة عائلة اشتراكًا ساريًا. السعر ٤٤٩ ريالًا سعوديًا سنويًا، تسبقه تجربة مجانية مدتها ٣٠ يومًا (ما لم يُمنح وصولٌ مجاني أو خاص من جانبنا).
- تُعالَج جميع المدفوعات عبر Apple App Store أو Google Play وفق شروط المتجر المعني؛ لا نستقبل بيانات بطاقتك ولا نخزّنها.
- التجديد تلقائي: يُجدَّد الاشتراك تلقائيًا في نهاية كل مدة ما لم تُلغِ التجديد من إعدادات حسابك في المتجر قبل انتهاء المدة بأربعٍ وعشرين ساعة على الأقل.
- الإلغاء والاسترداد: تُدار عمليات الإلغاء والاسترداد عبر المتجر الذي اشتريت منه ووفق سياساته. انتهاء الاشتراك قد يقيّد إنشاء محتوى جديد مع إبقاء بياناتك محفوظة وفق سياسة الخصوصية.
- قد نُعدّل الأسعار أو الباقات مستقبلًا، ويسري أي تعديل على المدد التالية فقط بعد إشعارك.
٥. مسؤوليتك عن بيانات العائلة والأقارب
تتضمّن شجرة العائلة بطبيعتها معلوماتٍ عن أشخاصٍ غير مستخدمين للتطبيق — وقد يشمل ذلك القُصَّر والمتوفّين. وعند إدخالك أو إدارتك لهذه البيانات بصفتك مشرفًا أو عضوًا:
- تُقرّ وتتعهّد بأن لديك أساسًا مشروعًا لإدخال تلك المعلومات (كونها جزءًا من سجلّ عائلتك)، وبأنها صحيحة قدر علمك، وبأنك تقتصر على ما يلزم لغرض حفظ نسب العائلة.
- تتحمّل وحدك المسؤولية عن المحتوى الذي تُدخله وعن مشروعية مشاركته داخل الشجرة، وتوافق على التعامل مع أي اعتراضٍ من صاحب البيانات والاستجابة لطلبات الإزالة أو التصحيح (انظر سياسة الخصوصية، البندين ٦ و١٠).
- تُعفينا وتُبرئ ذمّتنا مما قد ينشأ من مطالباتٍ تتعلّق بالبيانات التي أدخلتَها بالمخالفة لهذه الشروط، في حدود ما يسمح به النظام.
- لا نتحقّق من صحّة بيانات الأقارب التي يُدخلها المستخدمون ولا نضمنها.
٦. الاستخدام المقبول
تلتزم بألّا تستخدم التطبيق في: مخالفة الأنظمة السعودية؛ إدخال محتوى غير قانوني أو مسيء أو منتهِك لخصوصية الغير أو حقوقه؛ انتحال الهويات؛ محاولة اختراق الخدمة أو تعطيلها أو الوصول غير المصرّح به إليها أو إلى بيانات عائلاتٍ أخرى؛ أو استخدام الخدمة لأغراضٍ تجارية أو إعلانية دون إذننا.
٧. المحتوى والملكية الفكرية
- تبقى ملكية المحتوى الذي تُنشئه (الأسماء، والعلاقات، والأخبار، والمناسبات، والصور) لك أو لعائلتك. وتمنحنا بإدخاله ترخيصًا محدودًا باستضافته وعرضه داخل شجرتك لأفرادها وفق إعدادات الخصوصية، بالقدر اللازم لتشغيل الخدمة.
- أمّا التطبيق نفسه وتصميمه وعلامته التجارية «نخلتي» وشعاره ورموزه فهي ملكٌ للمشغّل، ولا يجوز نسخها أو استخدامها دون إذن.
٨. الخصوصية
تخضع معالجة بياناتك الشخصية لـسياسة الخصوصية، التي تُعدّ جزءًا لا يتجزّأ من هذه الشروط.
٩. إخلاء المسؤولية وحدودها
- تُقدَّم الخدمة «كما هي» و«حسب توفّرها» دون ضماناتٍ صريحة أو ضمنية، بما في ذلك دقّة بيانات العائلة التي يُدخلها المستخدمون أو استمرار توفّر الخدمة دون انقطاع.
- إلى الحدّ الذي يسمح به النظام، لا نتحمّل المسؤولية عن الأضرار غير المباشرة أو التبعية، ولا تتجاوز مسؤوليتنا الإجمالية — إن وُجدت — ما دفعتَه مقابل الاشتراك خلال الاثني عشر شهرًا السابقة للواقعة.
- لا يحدّ هذا البند من أي حقٍّ لا يجوز استبعاده نظامًا.
١٠. الإيقاف والإنهاء
- يجوز لنا تعليق حسابك أو إنهاؤه عند مخالفةٍ جوهرية لهذه الشروط أو عند اقتضاء النظام ذلك.
- يمكنك التوقّف عن استخدام التطبيق وحذف حسابك في أي وقتٍ من الإعدادات (انظر سياسة الخصوصية، البند ٩ بشأن مهلة السماح والاحتفاظ بسجلّ العائلة).
١١. تعديل الشروط
قد نُحدّث هذه الشروط من حينٍ لآخر، وننشر النسخة المُحدَّثة بتاريخ «آخر تحديث» جديد، ونُخطرك داخل التطبيق بالتغييرات الجوهرية. ويُعدّ استمرارك في الاستخدام بعد السريان قبولًا للتعديل.
١٢. القانون الواجب التطبيق وتسوية النزاعات
تخضع هذه الشروط لأنظمة المملكة العربية السعودية وتُفسَّر وفقها، وتختصّ الجهات القضائية المختصّة في المملكة بالنظر في أي نزاعٍ ينشأ عنها.

1. Acceptance of terms
By using the نخلتي ("Nakhlati", "the app", "the service") application, you agree to these Terms of Service and to the Privacy Policy; acceptance of them is a condition of using the service. The app is operated by an individual developer registered under freelance-practitioner certificate no. FL-851804199 ("we", "the operator").
2. The service
Nakhlati is a private application for building and sharing a family tree among its members: adding individuals and relationships, profiles, announcements, occasions, and viewing lineage within each family. The service is intended for private family use, not public publishing.
3. Eligibility and account
- You must be of legal age and have full legal capacity to enter into this agreement.
- Your account is your mobile phone number, verified by a one-time passcode. You are responsible for keeping access to your device and number secure, and for all activity under your account.
- You agree to provide accurate information, and not to impersonate others or sign in on another person's behalf without their permission.
4. Subscription, payment, and free trial
- Creating a family tree requires an active subscription. The price is SAR 449 per year, preceded by a 30-day free trial (unless complimentary or special access is granted by us).
- All payments are processed through the Apple App Store or Google Play under that store's terms; we do not receive or store your card details.
- Auto-renewal: the subscription renews automatically at the end of each term unless you cancel renewal in your store account settings at least 24 hours before the term ends.
- Cancellation and refunds: cancellations and refunds are handled by the store you purchased from, under its policies. When a subscription ends, creating new content may be restricted while your data is retained per the Privacy Policy.
- We may change prices or plans in the future; any change applies only to subsequent terms after we notify you.
5. Your responsibility for family data
A family tree by its nature contains information about people who are not app users — potentially including minors and deceased persons. When you enter or manage this data as an admin or member:
- You represent and warrant that you have a legitimate basis to enter that information (as part of your family record), that it is accurate to the best of your knowledge, and that you limit it to what is needed to preserve family lineage.
- You are solely responsible for the content you enter and the lawfulness of sharing it within the tree, and you agree to handle any objection from the data subject and to respond to removal or correction requests (see Privacy Policy §6 and §10).
- You indemnify and hold us harmless from claims arising out of data you entered in breach of these terms, to the extent permitted by law.
- We do not verify and do not warrant the accuracy of relatives' data entered by users.
6. Acceptable use
You agree not to use the app to: violate Saudi laws; enter unlawful, abusive, or privacy-infringing content; impersonate identities; attempt to breach, disrupt, or gain unauthorized access to the service or to other families' data; or use the service for commercial or advertising purposes without our permission.
7. Content and intellectual property
- Content you create (names, relationships, announcements, occasions, photos) remains owned by you or your family. By entering it, you grant us a limited license to host and display it within your tree to its members, subject to privacy settings, as needed to operate the service.
- The app itself, its design, the "Nakhlati" brand, logo, and marks are owned by the operator and may not be copied or used without permission.
8. Privacy
Processing of your personal data is governed by the Privacy Policy, which is an integral part of these terms.
9. Disclaimers and limitation of liability
- The service is provided "as is" and "as available" without express or implied warranties, including as to the accuracy of user-entered family data or uninterrupted availability.
- To the extent permitted by law, we are not liable for indirect or consequential damages, and our total liability — if any — does not exceed what you paid for the subscription in the twelve months preceding the event.
- This clause does not limit any right that cannot be excluded by law.
10. Suspension and termination
- We may suspend or terminate your account for a material breach of these terms or where required by law.
- You may stop using the app and delete your account at any time from settings (see Privacy Policy §9 on the grace period and retention of the family record).
11. Changes to these terms
We may update these terms from time to time, posting the updated version with a new "Last updated" date and, for material changes, notifying you in the app. Continued use after the effective date constitutes acceptance of the change.
12. Governing law and disputes
These terms are governed by and construed under the laws of the Kingdom of Saudi Arabia, and the competent judicial authorities in the Kingdom have jurisdiction over any dispute arising from them.
